THE IUBENDA SOLUTION
for developing your website policies
So, now that we have the “whether or not” issue reduced to “it is a must”, it is time to create (at the least) your privacy, GDPR, and cookie policies. How you do that depends on how much you have to spend and on how well you know and address your specific needs. For most website, blog, and web page owners, this does amount to rocket science.
START WITH A FREE POLICY GENERATOR
I do have an opinion about where to start. I believe that until you know what questions are going to be asked, the detail of answer to be rendered, how much information is specific to your site, page, profession, business, organization, and location, you should start with a free policy generator.
My answer is not acceptable to some. However, in my defense, I believe that one should look first at a free to use policy generator just to get some basic understanding as to what are generic terms and what terms specifically apply to one’s situation.
Furthermore, there really are some excellent policy generators available and to take a look at what is offered for free provides an excellent source of comparison – even to those designed by lawyers.
ARE POLICY GENERATORS MORE FLAWED THAN ANY OTHER METHOD?
As to the belief that policy generators are flawed because they are not designed by lawyers, that is not totally true. I am rather certain that some members of the legal teams that create policies are lawyers, and if not lawyers, then probably paralegals. For most, the need for a lawyer is unnecessary. Should the need present itself, you will be thoroughly prepared to discuss the matter with intelligence.
Policy generator companies tend to be totally focused on policy creation. Many policy generators are very sophisticated and know exactly what is needed to create a variety of policies lacking in excessive complexity. Get real. Don’t you think you should be able to understand the contents of your own policy and how it affects others (let alone exactly who those others are)?
Then, there is the fact that many policy generators are constantly updated to keep abreast of the changing times. Most generator systems will notify you when your policies need to be updated. Some will automatically update the policies for you.
No Mandated Policy in Place
Puts You At Risk For Penalties
For those enthusiasts who just want to get up and going with any sort of an internet presence, you need to be forewarned that haste makes waste and worse. The worse part includes being fined and shut down before you even get going.
WHAT IS INCLUDED
Generally, the basics of privacy and cookie policies include:
- Details about who you are, your company, and what types of personal data is being collected and how it is being used
- The legal basis for collecting such information, to whom it will be disclosed, and a notice regarding any international transfer of data
- Also included is the effective date of the policy and a mention as to the method by which policy changes and updates will be provided
- There is also a statement explaining how users may withdraw their consent regarding policy details and obtain the deletion of their data input
GENERATOR OR LAWYER – CHOOSE AT LEAST ONE!
There is so much to know about policy creation that one needs to either use a policy generator and the company providing it or use a lawyer.
I strongly recommend using a free policy generator to get started learning about all the details that must go into a policy if one is to avoid penalties.
